Alimony

Contrary to common belief, alimony is not awarded in every instance of divorce. Rather, the courts carefully examine the positions of each party and determine if there is a need for alimony (also known as spousal support or spousal maintenance). Family courts consider 13 factors to determine the need for alimony, such as the need and ability of the parties to pay, the length of the marriage, the earning capacity of the parties and the standard of living during the marriage.

The goal of alimony is to provide financial support to enable the dependant spouse to continue to live in a manner comparable to the marital standard of living.

Child Support

Every child has a fundamental right to be supported by both parents - regardless of the relationship of the parents. Therefore, when parents are no longer together, it is essential to establish child support based upon New Jersey's child support guidelines. This ensures the custodial parent has adequate support to provide a healthy environment for the child.

New Jersey child support guidelines involve a calculation using both parents' incomes and the number of children for which support should be provided. However, in many cases, additional factors should be considered, such as daycare expenses, health insurance expenses, expense of sports or activities and visitation time. In addition, if one parent is not earning up to his or her full earning potential, the court will calculate earnings based upon what he or she could/should be earning.
